Agreement to Terms

Welcome to Sending Stone Studio. These Terms of Service ("Terms") govern your access to and use of our website at sendingstonestudio.com and our products and services, including Living Atlas, Context Compass, Tavern Tally, and any other applications we offer (collectively, the "Services").

By accessing or using our Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not use our Services.

Eligibility

You must be at least 13 years old (or 16 in the EU/EEA) to use our Services. If you are under 18, you represent that you have your parent or guardian's permission to use the Services. By using the Services, you represent and warrant that you meet these eligibility requirements.

Account Registration

To access certain features of our Services, you may need to create an account. When you do:

• You agree to provide accurate, current, and complete information
• You are responsible for maintaining the security of your account credentials
• You are responsible for all activities that occur under your account
• You agree to notify us immediately of any unauthorized access to your account

We reserve the right to suspend or terminate accounts that violate these Terms or for any other reason at our sole discretion.

Acceptable Use

You agree not to use our Services to:

User Content

Our Services allow you to create, upload, and store content such as worlds, campaigns, characters, notes, and other creative materials ("User Content").

Ownership

You retain full ownership of your User Content. We do not claim any ownership rights over the creative works you produce using our Services.

License to Us

By uploading User Content, you grant us a limited, non-exclusive, worldwide license to store, display, and process your content solely for the purpose of providing and improving the Services. This license terminates when you delete your content or your account.

Your Responsibilities

You are solely responsible for your User Content. You represent and warrant that you have all necessary rights to the content you upload and that your content does not violate any third-party rights or applicable laws.

Content Removal

We reserve the right to remove any User Content that violates these Terms or that we find objectionable, without prior notice.

Intellectual Property

The Services, including all content, features, and functionality (excluding User Content), are owned by Sending Stone Studio and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of our Services without our prior written consent.

Free and Paid Services

Some of our Services are offered for free, while others require payment. For paid Services:

• You agree to pay all applicable fees as described at the time of purchase
• Subscription fees are billed in advance on a recurring basis (monthly or annually)
• You may cancel your subscription at any time; cancellation takes effect at the end of the current billing period
• We do not provide refunds for partial subscription periods unless required by law
• We reserve the right to change our pricing with reasonable notice

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

We do not warrant that the Services will be uninterrupted, secure, or error-free, that defects will be corrected, or that the Services are free of viruses or other harmful components.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SENDING STONE STUDIO SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES.

Our total liability for any claims arising from or related to these Terms or the Services shall not exceed the amount you paid us in the twelve (12) months preceding the claim, or $100, whichever is greater.

Indemnification

You agree to indemnify, defend, and hold harmless Sending Stone Studio and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorney's fees) arising out of or related to your use of the Services, your User Content, or your violation of these Terms.

Termination

You may terminate your account at any time by contacting us or using the account deletion feature in your settings. We may suspend or terminate your access to the Services at any time, with or without cause, and with or without notice.

Upon termination, your right to use the Services will immediately cease. We will make your data available for export for a reasonable period following termination, after which it may be deleted.

Governing Law and Disputes

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions. Any disputes arising from or relating to these Terms or the Services shall be resolved through binding arbitration, except where prohibited by law.

Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the Services after any changes constitutes your acceptance of the new Terms.

Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Sending Stone Studio regarding your use of the Services and supersede any prior agreements.
